Key takeaways

  • Start with free credit reports and a full list of every balance, rate and due date.
  • Compare hardship programs, counseling, consolidation, settlement and bankruptcy before choosing.
  • Judge any debt loan by total paid, fees and term, not just the monthly payment.
  • Payday loan fees compound through rollovers; stopping the rollover comes first.
  • Miami clients work with PeakStone's West Palm Beach headquarters by phone, online or by appointment.

Your Debt Relief Miami Checklist in Five Steps

Use this page as a worksheet and check items off as you go.

  1. Inventory: pull your credit reports and list every debt you owe.
  2. Compare relief options: hardship programs, counseling, consolidation, settlement and bankruptcy.
  3. Vet any loan offer: APR, origination fee, term and prepayment rules.
  4. Deal with payday debt first if you have it, because the fees stack fastest.
  5. Get a second set of eyes before you sign anything.

If you only have ten minutes today, do step one and stop. For the bigger picture on the city itself, see our Miami resource page.

Step 1: Pull Your Reports and List Every Balance

Go to AnnualCreditReport.com and download your reports from all three bureaus. They are free and available weekly. Then build a table with these columns:

  • Creditor name and account type (card, auto, personal loan, medical, payday)
  • Current balance and interest rate or fee
  • Minimum payment and due date
  • Status: current, late, in collections or charged off

Flag anything that looks wrong, like an account you never opened. Errors can be disputed, and under the FCRA the bureaus generally investigate within about 30 days. Our guide on how to read your credit report walks through each section, and a credit report review can help if the file is long or confusing.

Know the Miami Pressures Behind the Numbers

Write down why the debt grew. In Miami it is often a mix of these:

  • Housing costs. Rent from Brickell to Allapattah and Little Havana takes a heavy share of many paychecks, and condo owners can face special assessments.
  • Insurance. Homeowners, flood and auto premiums in South Florida can jump at renewal.
  • Hurricane season. From June through November, storm prep, evacuation costs, deductibles and lost work days can hit all at once.
  • Seasonal income. Tourism, hospitality, cruise and port work, and restaurant jobs can swing with the season, while healthcare, trade, finance and construction pay can be steadier but still uneven for hourly staff.
  • Commuting. Tolls and gas on I-95, the Palmetto Expressway, the Dolphin Expressway or the Turnpike add up, even for households that use Metrorail or Metrobus part of the week.

A loan will not fix a budget that runs short every month, so this list shapes everything that follows.

Step 2: Compare Real Debt Relief Options Side by Side

There is no single right answer, so compare at least three of these against your table:

  1. Creditor hardship programs. Call each card issuer or lender and ask whether a hardship plan, reduced rate or temporary payment change is available.
  2. Nonprofit credit counseling and debt management plans. A counselor reviews your budget and may set up a plan where you make one payment and creditors may lower rates. The National Foundation for Credit Counseling lists member agencies.
  3. Consolidation loans. One new loan pays off several balances. Helpful only if the total cost is lower and you stop adding new debt (step 3 covers this).
  4. Debt settlement. Typically involves missed payments, fees and credit damage, and creditors are not required to settle. Forgiven amounts may be taxable and reported on Form 1099-C.
  5. Bankruptcy. A legal option with long-term credit effects; some bankruptcies can stay on a report up to 10 years. Discuss it with a licensed bankruptcy attorney.

Step 3: Vet Debt Loans in Miami Before You Sign

When people search for debt loans in Miami, they usually mean a consolidation loan, a personal loan or a refinance of an existing loan. Treat every offer the same way. Ask for the written terms, then check:

  • APR, not just the interest rate. APR folds in certain fees so offers can be compared.
  • Origination fee. Is it taken out of the loan amount? If so, you may need to borrow more to pay off the same balances.
  • Term. A longer term lowers the monthly payment but usually raises the total paid.
  • Prepayment rules. Can you pay early without a penalty?
  • Total of payments. Multiply the monthly payment by the number of months and compare it to what you owe now.
  • Who the lender is. Confirm the company is licensed through the Florida Office of Financial Regulation.

Your debt-to-income ratio affects what offers you may see; our explainer on understanding debt-to-income ratio shows how to calculate it. More detail on local debt consolidation in Miami is on our consolidation loans for Miami page.

Run the Numbers: A Hypothetical Consolidation Comparison

Here is a made-up example to show the method. These are hypothetical figures, not real offers or current rates. Say you owe $12,000 on cards and see two offers:

Hypothetical offerOffer AOffer B
APR (hypothetical)14%11%
Origination feeNone6%, deducted from the loan
Amount borrowed to net $12,000$12,000About $12,766
Term36 months60 months
Monthly paymentAbout $410About $278
Total paidAbout $14,765About $16,654
Cost above the $12,000 owedAbout $2,765About $4,654

Offer B has the lower rate and payment, yet costs roughly $1,900 more here because of the fee and two extra years. Compare the total paid.

Check Whether a Loan Will Help or Backfire

Answer yes or no to each line before accepting a consolidation or personal loan:

  • The total paid is lower than staying on my current plan.
  • The monthly payment fits my budget even in a slow season or a storm month.
  • I have a plan to stop using the cards I pay off.
  • I understand every fee and whether the rate is fixed.

Two or more no answers means a loan may just move the problem around. The most common backfire is paying off cards, then running them back up, leaving you with the loan and new balances at the same time.

Step 4: Do the Math on Payday Loans in Miami

Payday loans in Miami work the same way they do elsewhere: a small, short-term loan, usually due on your next payday, repaid by a postdated check or an electronic debit from your bank account. The flat fee looks small until you annualize it or roll the loan over.

Hypothetical example: you borrow $400 for two weeks with a $60 fee. That fee is 15% of the amount borrowed for 14 days, which works out to roughly 390% on an annual basis. If you cannot repay and pay only the fee to extend four more times, you have paid $300 in fees and still owe the original $400.

Florida sets its own rules on these loans, so do not rely on what you read about other states. Check the Office of Financial Regulation for the current law and to confirm a lender's license, and read the CFPB's payday loan resources. PeakStone never recommends taking a payday loan; our payday loans in Miami page explains the risks in more detail.

Getting Out of Payday Debt: Do This in Order

  1. Stop the rollover. Do not take a new payday loan to pay the old one.
  2. Ask the lender about options. Ask in writing whether an extended payment plan or other repayment arrangement is available.
  3. Protect your bank account. Per the CFPB, you can revoke the ACH authorization that lets the lender debit your account. Notify the lender and your bank in writing and keep copies.
  4. Know your rights with collectors. The FDCPA limits how debt collectors can contact and treat you. The CFPB also notes you cannot be arrested for defaulting on a payday loan, and lenders generally need a court order to garnish wages.
  5. Military families: the Military Lending Act caps the Military APR at 36% for covered loans to servicemembers and dependents.
  6. Line up alternatives for the next emergency, such as a small savings buffer or a nonprofit counselor.

Spot Upfront-Fee Relief Scams Before They Cost You

Walk away if a company does any of the following:

  • Asks for a fee before it has settled or reduced any of your debts. FTC rules generally bar debt relief companies that sell by phone from charging before settling a debt.
  • Charges for credit repair before the work is done. The Credit Repair Organizations Act bars that and gives you three business days to cancel.
  • Promises a specific score or a loan.

You can report suspected scams to the Florida Attorney General and look up companies through the state regulator. Our FAQ explains what PeakStone does and does not do.

Frequently asked questions

Does PeakStone Credit have an office in Miami?

No. Miami residents are served by our West Palm Beach headquarters at 13870 Creston Pl. Nearly everything can be handled by phone and online, including reviewing your credit reports, building a budget and comparing options. If you would rather meet in person, visits at headquarters are available by appointment, which you can request through our contact page.

Can PeakStone get me a debt consolidation loan?

No. PeakStone is not a lender, bank or loan broker and does not make or arrange loans. What we can do is review your credit and budget, help you read the terms of any offer you receive, and compare it against non-loan options like hardship programs or a nonprofit debt management plan, so you decide with the full picture.

What should I do first if a payday lender keeps debiting my account?

Stop taking new payday loans to cover old ones, then revoke the ACH authorization in writing with both the lender and your bank, as the CFPB describes. Keep copies of everything. Ask the lender in writing about any repayment plan, and check the Florida Office of Financial Regulation for the rules that apply and to verify the lender's license.

Is debt settlement a good option for Miami residents?

It depends on your situation. Settlement typically involves missed payments, fees and credit damage, and creditors are not required to agree. Forgiven debt may be taxable and reported on Form 1099-C. It can make sense for some people with large unsecured balances, but compare it with counseling, hardship plans and talking to a bankruptcy attorney first.

How do I check whether a lender or debt relief company is legitimate in Florida?

Look the company up through the Florida Office of Financial Regulation, and check for complaints or report concerns to the Florida Attorney General. Be cautious of any company that asks for fees before settling a debt, promises specific results, or pressures you to sign quickly. Get every term in writing before you agree.
